Legal and partner controls
This operational summary forms part of the NexaFlow course-enrolment process. The final partner agreement and learner terms must be reviewed by a South African attorney before paid partner courses open.
Accredited partner requirements
- Current QCTO, SETA or other legally applicable accreditation for the exact programme
- Accreditation number, approved programme scope and expiry independently verified
- Qualified facilitators, assessors and moderators assigned where required
- Public-liability and professional-indemnity insurance suitable for the training risks
- Approved venue, equipment, PPE, emergency arrangements and practical assessment controls
- POPIA-compliant learner records, attendance evidence, assessment and certificate registers
- Written responsibility for incidents, injuries, complaints, refunds, reassessments and certificates
Responsibility and certificate issuer
Wilsons Technologies CC operates the NexaFlow marketplace, enrolment and learner-support platform. The accredited training partner is responsible for the accuracy of its accreditation claims, practical delivery, safety controls, competency assessments and certificates. NexaFlow will not issue or alter an accredited competency certificate.
Learner safety obligations
Learners must disclose relevant restrictions, follow lawful instructions, wear required PPE and stop work when conditions are unsafe. Enrolment never guarantees competence, employment, site access or successful assessment.
Risk, incidents and insurance
The partner must complete course-specific risk assessments and maintain suitable insurance. All incidents, near misses, equipment failures and learner complaints must be reported, investigated and retained under the agreed procedure. Nothing in the terms excludes liability that South African law does not permit a supplier to exclude.
Cancellations, refunds and changes
No payment is taken for a partner course while its provider remains unverified. Confirmed bookings will state the partner, venue, prerequisites, final price, cancellation window, substitution rules and refund process before payment.
Privacy and records
Only necessary learner information may be shared with the selected partner for delivery, assessment, certification and legally required recordkeeping. Each party must apply POPIA safeguards and notify the other party of a suspected breach without delay.
